The injuries sustained in a slip and fall accident can be quite serious, and can end up causing a person to suffer from unnecessary pain for some time to come. Some of these injuries can even affect a person for the rest of their life. Often times these injuries could also have been prevented had a property owner just taken the proper precautions to make sure that the area was kept reasonably safe.
Sadly, some owners fail to make sure that their property is free of falling hazards, and don't make sure that things like debris and spills are quickly cleaned up. When this happens in a store, for the unsuspecting shopper, the spill can cause a fall.
One woman, who was injured when she fell inside of a Walgreens in New Orleans, has decided to hold the store accountable for not cleaning up the substance that she slipped on inside of the Bullard Avenue store. She has filed a premises liability lawsuit against Walgreens Louisiana.
The woman claims that when she fell, she came down on her right elbow and arm. In the end, she ended up suffering from injuries to her back, neck and head. Now, she would like compensation to pay for the physical pain and suffering that the entire ordeal caused. Damages are also being sought after for the loss of wages that the accident caused her, as well as for her medical expenses, and mental pain and suffering.
When looking at this case, it will most likely be argued that if Walgreen's employers had been more tentative to the spilled substance, it could have been cleaned up and/or shoppers could have at the very least been warned that there was a fall hazard in the store.
