A Winn-Dixie shopper is suing the supermarket chain claiming that the company should be held liable for the injuries she sustained after falling on some grapes that were left on the floor of a New Orleans store. From falling, she sustained injuries to her legs, hip, back and shoulder.
The slip and fall accident happened back in August 2010, and the premises liability lawsuit was filed later on the same month of the accident. Earlier this month, that same lawsuit was removed to a federal New Orleans court.
The woman who was injured at the Winn-Dixie store is seeking damages for a number of reasons, including mental anguish, pain and suffering, medical expenses and for the loss of enjoyment of life.
According to the lawsuit, Winn-Dixie should be held responsible for her injuries since the company had allowed for a number of grapes to be left on the floor, and for not even warning shoppers about the inherent slip and fall danger.
When looking at these types of accidents, it's important to keep in mind that owners have a responsibility to make sure that their premises are kept safe and secure. This means that spills need to be promptly cleaned up, and debris of any kind -- including grapes -- cannot just be left lying on the ground. Unfortunately, even though owners know they have this responsibility, not all keep up with their property. This means that in cases where a person is hurt, there is a possibility that a negligent owner could be held liable for those personal damages.
